Document requirements RPTKA

The  Foreign Manpower Utilization Plan (Rencana Penggunaan Tenaga Kerja Asing, better known as RPTKA) must be submitted to the Ministry of Manpower in order to obtain a Work Permit (IMTA) for a foreign worker in Indonesia. There are several types of RPTKA:

  1. for urgent/emergency and temporary work permit ( 1 month);
  2. for a temporary work permit (2-6 months); and
  3. for a long term work permit (7-12 months).

The document requirements for each type of RPTKA are discussed below.

Document requirements for urgent/emergency and temporary RPTKA (1 month)

An urgent/emergency RPTKA is issued for a maximum period of 1 month. It is issued for jobs to be performed by a foreign worker which have an emergency and urgent nature which required immediate attention and which, if not dealt with promptly, can result in fatal loss to the company and / or the general public. Besides that the Ministry of Manpower can issue a temporary RPTKA for a maximum period of 1 month. The procedure set by the Ministry of Manpower for both types are therefore less stringent.

The document requirements are as follows:

  1. Sponsor letter and Letter of Attorney;
  2. Copy ID Card of the signatory of sponsor letter;
  3. Form of RPTKA;
  4. Business License;
  5. Statement letter which states the reason of the urgent/emergency work from the company.
  6. Recommendation from a government body for certain types of sponsor company (optional) (e.g. oil and gas, mining, coal, sport, banking, finance, insurance and social).

Document Requirements for Temporary RPTKA (2-6 months)

A temporary RPTKA is issued for a maximum period of 6 months. The temporary RPTKA is only issued for certain types of jobs, which are described in the Ministry of Manpower regulation number 16 of 2015 as amended by regulation number 35 of 2015 regarding the procedure for the utilization of foreign workers:

  1. creating of commercial film that has obtained license from the authorized institution;
  2. conducting an audit, production quality control, or inspection in company’s branches in Indonesia within the period of 1 month;
  3. machinery installation, electrical, after-sales service, or product in business trial phase; and
  4. jobs which have a duration between 2 – 6 months (this is not specifically regulated, but general practice).

The document requirements are as follows:

  1. Sponsor letter and letter of attorney;
  2. Copy ID card of the signatory of the sponsor letter;
  3. Form of RPTKA;
  4. Business license of the sponsor company;
  5. Deed of establishment and the last amendment of the sponsor company;
  6. Decree of Minister of Law and Human Rights;
  7. Organization chart of the sponsor company;
  8. Domicile letter of the sponsor company;
  9. Mandatory manpower report of the sponsor company;
  10. Tax registration (NPWP) of the sponsor company;
  11. Company registration (TDP) of the sponsor company; and
  12. Recommendation from another institution for certain type of sponsor company (optional) (e.g. oil and gas, mining, coal, sport, banking, finance, insurance and social).

Document requirements for a long term RPTKA (7-12 months)

A normal (long term) RPTKA is issued for a maximum period of 12 months, which is issued for all other jobs which are not mentioned in above categories.

The document requirements are as follows:

  1. Sponsor letter and Letter of attorney;
  2. Copy ID Card of the signatory of the sponsor letter;
  3. Form of RPTKA;
  4. Business license of the sponsor company;
  5. Deed of establishment and the last amendment of the sponsor company;
  6. Decree of Minister of Law and Human Rights;
  7. Organization chart of the sponsor company;
  8. Domicile letter of the sponsor company;
  9. Mandatory manpower Report;
  10. Tax registration (NPWP) of the sponsor company;
  11. Company registration (TDP) of the sponsor company;
  12. Appointment letter of local co-worker of the foreign worker (TKI Pendamping);
  13. CV, education certificate, job description, ID card and photo of the local co-worker;
  14. Recommendation from another institution for certain type of company (optional) (e.g. oil and gas, mining, coal, sport, banking, finance, insurance and social);
  15. Registration Letter (SKT) (optional) (e.g. Oil and Gas  and Energy and Mineral Resources);
  16. LKPM report (optional);
  17. The reason why the company cannot replace the expat (for extension);
